Terms and Conditions of Sale

Neds Pots by Evans Ceramics

1. General

These Terms and Conditions apply to all sales of handmade studio pottery pieces (“Items”) made by the seller (“Seller”) to the purchaser (“Buyer”). By completing a purchase, the Buyer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.

2. Nature of Handmade Work

All Items are individually handmade using traditional studio pottery techniques. Each piece is unique and will exhibit natural variations that are an inherent and valued part of the handmaking process. These characteristics are not defects or flaws — they are the hallmarks of authentic handcrafted work.

Such characteristics may include:

  • Variations in glaze colour, surface texture, and finish between pieces, and even across a single piece
  • Minor irregularities in form, thickness, weight, and profile
  • Small surface marks, throwing lines, fingerprints, or tool marks introduced during forming
  • Slight asymmetry or variation from perfectly uniform geometry
  • Natural crawling, pinholing, colour pooling, or other glaze movement effects
  • Kiln marks or minor atmospheric variation resulting from the firing process
  • Iron spotting, flashing, or other clay body characteristics

These variations add individuality and character to each piece and are considered desirable qualities of handmade studio pottery. Photographs are representative only. Slight differences between the Item depicted and the Item received do not constitute grounds for return, exchange, or complaint.

3. Food Safety, Glazing & Micro-Crack Disclosure

3.1 — Glaze Design Intent

Functional Items intended for food and beverage use are glazed on all interior food-contact surfaces using glazes specifically formulated to be food-safe and to resist crazing. The Seller has taken reasonable care in the formulation and testing of interior glazes to minimise the risk of crazing in normal domestic use.

3.2 — Risk of Micro-Cracking

The Buyer is advised that micro-cracks — fine, hairline fractures in the glaze or clay body — can occur over time due to factors including:

  • Repeated thermal cycling (e.g. hot liquids, dishwasher cycles, microwave use)
  • Impact or mechanical shock, including dropping, knocking, or stacking
  • Prolonged exposure to acidic foods or beverages
  • Age and general wear in normal domestic use

Micro-cracks can harbour bacteria, mould, and other microorganisms even after washing. This risk is present in all handmade ceramic functional ware.

3.3 — Care Recommendations

To minimise risk and maintain food safety:

  • Hand wash in warm water with mild detergent
  • Avoid sudden or extreme temperature changes (thermal shock)
  • Avoid microwaving unless confirmed suitable
  • Inspect regularly for crazing, cracking, or chipping — discontinue use if found
  • Discontinue use if the Item develops a persistent odour or discolouration

4. Assumption of Risk & Limitation of Liability

4.1 — Buyer Assumes All Risk

All Items are purchased and used entirely at the Buyer's own risk. The Seller makes no warranty, express or implied, regarding the fitness of any Item for any particular purpose, including use for food or beverage contact.

4.2 — No Liability for Personal Injury or Loss

To the maximum extent permitted by law, the Seller shall not be liable for any personal injury, illness, property damage, loss, or consequential damage arising from:

  • The use or misuse of any Item purchased from the Seller
  • Development of micro-cracks, crazing, chipping, or degradation after purchase
  • Presence of bacteria, mould, or other contaminants in or on an Item
  • Any food or beverage safety issue arising from use of any Item
  • Any failure resulting from handling, impact, thermal shock, or any other cause

4.3 — No Warranty of Merchantability

All Items are sold as handmade studio art and craft objects. The Seller does not warrant that any Item meets any particular food safety standard, regulatory requirement, or commercial specification. The Buyer is solely responsible for determining suitability for their intended use.

5. Returns, Exchanges & Disputes

Returns or exchanges will not be accepted on the basis of:

  • Natural variation in colour, texture, glaze finish, or form from photographs or descriptions
  • Minor surface marks, asymmetry, or irregularities consistent with handmade production
  • Glaze characteristics such as crawling, pinholing, pooling, or colour variation

Returns may be considered at the Seller's sole discretion for genuine structural defects that render an Item entirely non-functional, provided the Buyer contacts the Seller within 7 daysof receipt with photographic evidence. Items must be returned in original condition, securely packaged, at the Buyer's expense.

6. General Care of Pottery

🤲Handle with care — ceramic is fragile and susceptible to chipping from impact
📦Store safely — avoid stacking without protection between pieces
🌡️Avoid sudden temperature changes that could cause thermal shock
🧽Clean gently — avoid abrasive scouring pads that may scratch glaze

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

8. Acknowledgement

By purchasing an Item from the Seller, the Buyer confirms that they:

  • Have read and understood these Terms and Conditions
  • Accept all risks associated with the purchase and use of handmade studio pottery
  • Agree that the Seller's liability is limited as set out above
  • Understand and accept the inherent characteristics of handmade ceramic ware
